1. Acceptance of Terms

By accessing or using MilAssist, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

2. Service Description & AI Processing Requirement

MilAssist provides military document formatting, career guidance, and professional development tools for military personnel across all branches.

Important: This service is UNCLASSIFIED ONLY and not authorized for classified or sensitive military information.

Use of AI Processing

Our services rely on artificial intelligence ("AI") to function. By creating an account, accessing, or using our platform, you acknowledge and agree that:

1. Essential Functionality:

AI processing is an integral and necessary part of delivering the service. Disabling or avoiding AI processing would prevent the service from functioning as intended.

2. Scope of Processing:
  • Your data, including personal information and any content you upload or generate, may be processed by AI models to provide core features, improve accuracy, and enhance performance.
  • Processing may include automated analysis, content generation, predictions, formatting, summarization, and other algorithmic operations.
3. Human Oversight:

While certain features operate without direct human review, we maintain oversight procedures to ensure lawful and fair use of AI outputs where required by applicable law.

4. Consent to AI Processing:

By using this service, you consent to the use of AI processing as described. If you do not consent, you may not create an account or use the service.

5. Jurisdiction-Specific Rights:
  • European Economic Area (EEA): You have the right under GDPR Article 22 to request human review of decisions made solely by automated means if such decisions produce legal or similarly significant effects.
  • California & Other U.S. States: You may have rights under CCPA/CPRA or similar state laws to request information about automated decision-making and profiling.
  • Canada: Under PIPEDA and future legislation, you may request an explanation of how AI processing affects you.

3. Account Registration & Security

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • Multi-factor authentication is required for enhanced security
  • You must notify us immediately of any unauthorized access to your account
  • One account per person; sharing accounts is prohibited

4. Subscription & Billing

Free Trial: All premium tiers include a 3-day free trial requiring valid billing information

Automatic Billing: After the trial period, you will be automatically charged unless you cancel

Cancellation: You may cancel your subscription at any time from your account settings

Refunds: Refunds are provided according to our refund policy and applicable consumer protection laws

Price Changes: We may modify subscription prices with 30 days advance notice

5. Acceptable Use Policy

Prohibited Uses:

  • Processing classified, FOUO, or sensitive military information
  • Inputting personally identifiable information (PII) of others without consent
  • Using the service for any illegal activities or OPSEC violations
  • Attempting to breach security measures or access unauthorized areas
  • Creating multiple accounts to circumvent usage limits
  • Sharing login credentials or account access with others

Military Compliance:

  • Users must comply with their unit's cybersecurity policies
  • Chain of command approval may be required for certain usage
  • Service members remain responsible for adhering to military regulations

6. Intellectual Property

Our Content: All MilAssist software, designs, and documentation are owned by Mil Assist LLC

Your Content: You retain ownership of documents and content you create using our tools

License Grant: You grant us a limited license to process your content to provide our services

Local Export Mode: In Local Export Only mode, no content is retained server-side

7. Data Protection & Privacy

Data Processing: We process your data according to our Privacy Policy

Security Measures: Military-grade encryption and security protocols protect your information

Data Retention: Standard retention periods apply unless Local Export Only mode is enabled

Third-Party Services: We use trusted providers (Stripe, OpenAI) with appropriate safeguards

8. Service Availability & Support

Uptime: We strive for 99.9% uptime but cannot guarantee uninterrupted service

Maintenance: Scheduled maintenance will be announced in advance when possible

Support: Customer support is available via email during business hours

Feature Changes: We may modify, update, or discontinue features with reasonable notice

9. Limitation of Liability

MilAssist is provided "as-is" without warranties of any kind. We are not liable for:

  • Career decisions made based on our guidance or recommendations
  • Consequences of using generated documents in official military contexts
  • Data loss or security breaches beyond our reasonable control
  • Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for the service in the preceding 12 months.

10. Military Use Disclaimer

NOT AN OFFICIAL MILITARY SYSTEM: MilAssist is not endorsed by or affiliated with any branch of the U.S. Armed Forces

Unofficial Tool: This is a civilian-developed productivity tool for personal and administrative use

No Guarantee: We make no representations about compliance with specific military regulations

User Responsibility: Service members are responsible for ensuring their use complies with military policies

11. Account Termination

By You: You may terminate your account at any time from account settings

By Us: We may terminate accounts for violations of these terms or suspicious activity

Effect of Termination: Upon termination, your access ends and data may be deleted according to our retention policy

Survival: Sections regarding liability, intellectual property, and disputes survive termination

12. Governing Law & Disputes

These terms are governed by the laws of the State of Texas, United States

Disputes will be resolved through binding arbitration in San Antonio, Texas

You waive the right to participate in class action lawsuits

Arbitration will be conducted according to American Arbitration Association rules

13. Changes to Terms

We may update these terms at any time to reflect legal requirements or service changes

Material changes will be communicated via email and in-app notifications

Continued use after changes constitutes acceptance of new terms

If you disagree with changes, you must discontinue use of the service
